1. Who these terms are with
This website at sfhr.org is operated by sfHR Consulting (“we”, “us”). By using the site you accept these terms. If you do not accept them, please do not use the site.
2. This site is information, not advice
Everything on this site is general information about our services. It is not advice about your organization, your employees, or your situation, and it must not be relied on as such.
We are not a law firm. We do not practise law and we do not give legal advice. Nothing on this site, and nothing in any message sent through it, creates an attorney-client relationship or attracts legal privilege. Employment law questions belong with a licensed attorney.
We do not conduct workplace investigations. In California that work is reserved to licensed private investigators and to attorneys. Where an investigation is required we will say so and refer you to someone qualified to conduct it.
We are not a professional employer organization. We do not act as a co-employer or employer of record, and we do not assume any employer’s legal obligations. Our clients remain the employers of their own people and retain final authority over every employment decision.
Employment law changes constantly, and pages on this site may become out of date. We do not undertake to keep them current.
3. Contacting us does not engage us
Sending a message through this site, or having a preliminary conversation with us, does not create a consulting engagement and does not oblige either of us to proceed. A consulting relationship begins only when a written engagement letter is signed by both parties, and it is that letter, not this page, that governs the work.
Please do not send confidential or sensitive information through this site before an engagement exists. Messages sent through the site are not protected by any privilege and are handled as described in our privacy policy.
4. Using the site
You may read this site, and print or save pages from it, for your own business use. You may not:
- use it for any unlawful purpose, or in a way that interferes with anyone else’s use of it;
- attempt to gain access to any part of the site, its server, or its database that is not publicly available;
- submit anything to the site that is false, that impersonates another person, or that contains malicious code;
- use automated means to scrape, harvest, or overload the site, or to submit forms;
- use the contact form to send unsolicited commercial messages; or
- copy the content of this site for republication or for a competing service.
5. What you send us
You keep ownership of anything you send us. By sending it you confirm that you are entitled to send it, that it does not infringe anyone’s rights, and that you have any consent needed for personal information about other people contained in it. You give us permission to use what you send for the purpose of responding to you and evaluating the inquiry.
6. Our content
The text, design, logo, and other material on this site belong to us or are used with permission, and are protected by copyright and trademark law. Our name and mark may not be used without our written consent. You may quote short extracts with attribution and a link.
7. Links to other sites
Where we link to another organization’s website, we do so for convenience. We do not control those sites, we are not responsible for their content or their privacy practices, and a link is not an endorsement.
8. Availability
We try to keep the site available and accurate, but we do not promise that it will be uninterrupted, error-free, or free of harmful components. We may change, suspend, or withdraw any part of it at any time.
9. Disclaimer
To the fullest extent the law allows, this site and its content are provided “as is” and “as available”, without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
10. Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of your use of this site or your reliance on anything published on it. Our total liability arising out of or relating to this site will not exceed one hundred United States dollars.
This clause limits liability for the website only. It does not limit our liability under any engagement letter, which contains its own terms, and it does not exclude any liability that cannot lawfully be excluded, including liability for fraud or for death or personal injury caused by negligence.
11. Indemnity
You agree to indemnify us against claims, losses, and reasonable legal costs arising from your misuse of this site or your breach of these terms. This does not apply to anything caused by our own act or omission.
12. If something goes wrong
If you have a complaint about this site, please tell us through the contact form, or telephone (925) 832-7732, and give us thirty days to resolve it. Most problems are solved faster this way than by any other route, and nothing in this paragraph prevents either of us from going to court if it is not.
13. Governing law
These terms are governed by the law of the State of California, without regard to its conflict of laws rules. Any dispute arising out of them or out of your use of this site will be brought exclusively in the state or federal courts located in California, and both of us consent to the jurisdiction of those courts.
14. General
If any part of these terms is held unenforceable, the rest continues to apply. Our not enforcing a term on one occasion does not waive it. These terms, with the privacy policy, are the whole agreement between us about your use of this site. You may not transfer your rights under them; we may transfer ours if our practice is transferred.
15. Changes to these terms
We may revise these terms. The revised version is posted here with a new date and applies to use of the site from that date. If you continue to use the site after a change, you accept the revised terms.
